Welcome to Substance Check. By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully before using our drug and alcohol testing, compliance, and training services.

1. Services Description

Substance Check provides the following services:

  • DOT and Non-DOT drug and alcohol testing
  • FMCSA Clearinghouse management and reporting
  • Background verification services
  • Consortium and random pool management
  • Professional training programs
  • Drug test policy development

All services are provided in accordance with applicable federal and provincial regulations, including FMCSA requirements under 49 CFR Parts 40 and 382.

2. User Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Comply with all applicable laws and regulations
  • Use our services only for lawful purposes
  • Not share testing results or confidential information inappropriately
  • Notify us immediately of any unauthorized account access

3. Payment Terms

  • All fees are due as specified in your service agreement
  • Prices are subject to change with 30 days notice
  • Late payments may incur additional fees
  • Consortium membership fees are non-refundable
  • Training course purchases are final once access is granted

4. Limitation of Liability

Substance Check shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or business opportunities
  • Delays caused by third-party laboratories or service providers
  • Actions taken by regulatory agencies based on reported results
  • Technical failures beyond our reasonable control

Our total liability shall not exceed the fees paid for the specific service in question.

5. Termination

Either party may terminate services:

  • With 30 days written notice for consortium memberships
  • Immediately for breach of these terms
  • Immediately for non-payment of fees

Upon termination, we will retain records as required by law and provide necessary documentation for regulatory compliance.

6. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Ontario, Canada.
